Andrew Golf Sweeps Policy

Effective as of January 1, 2025

NO PURCHASE, PAYMENT, OR OTHER CONSIDERATION NECESSARY TO PARTICIPATE. A PURCHASE OR PAYMENT OF ANY KIND DOES NOT AFFECT AND WILL NOT INCREASE A PARTICIPANT'S CHANCES OF WINNING.

This Sweeps Policy is integrated into and made a part of the Andrew Golf Terms of Service (“Terms”). Andrew Golf is an entertainment platform which offers golfers the opportunity to compete in peer-to-peer gaming and wagering for golf.

As part of our promotional efforts, we give away entries for sweepstakes credit in your Andrew.Golf account. Sweepstakes Credits can be redeemed for entry fees and wagering credits related to the Services we provide. It is strictly prohibited by this Sweeps Policy and the Terms to buy, sell, trade, or attempt to buy, sell, or trade any Sweepstakes Credit. In addition to a violation of this Sweeps Policy and the Terms, such conduct may be illegal. We reserve the right to report any actual or suspected illegal conduct to the appropriate law enforcement authorities.

IMPORTANT: THIS SWEEPS POLICY INCORPORATES SECTION 10 OF THE TERMS, WHICH INCLUDE A PROVISION WAIVING THE RIGHT TO PURSUE ANY CLASS, GROUP OR REPRESENTATIVE CLAIM AND REQUIRING YOU TO PURSUE PAST, PENDING, AND FUTURE DISPUTES BETWEEN YOU AND US THROUGH INDIVIDUAL ARBITRATION UNLESS YOU OPT OUT WITHIN THE SPECIFIED TIME FRAME IN WRITING AS PROVIDED IN SECTION 10 OF THE TERMS.

1. General.

1. Eligibility. Our Sweepstakes Promotion is open only to legal residents of the United States (excluding states where Andrew.Golf does not permit real money play, and states where otherwise prohibited), who are at least 18 years of age or the age of majority in their jurisdiction (whichever is older) at the time of entry. VOID WHERE PROHIBITED BY LAW.

2. Obligation to Verify. You understand and agree that it is your sole responsibility to verify that you may participate in the Sweepstakes under the applicable laws of your jurisdiction. We make no representation or claim that your ability to access the Sweepstakes from your location renders such access lawful, as it is up to you to determine the legality of your participation.

3. Agreement and Decisions. Your participation in the Sweepstakes constitutes full and unconditional agreement to this Sweeps Policy (as well as the Terms and any policies integrated therein) and any of our decisions regarding the outcomes of such Sweepstakes, which in all cases are final, binding, and non-appealable.

4. Sweepstakes Credit Eligibility. Obtaining Sweepstakes Credit is contingent upon fulfilling all requirements set out in this Sweeps Policy (“Sweepstakes Rules”). Our employees, any of their respective affiliates, subsidiaries, holding companies, advertising agencies, or any other company or individual involved with the design, production, execution or distribution of the Sweepstakes and their immediate family (spouse, parents, siblings and children, whether the relationship is by birth, marriage or adoption) and household members (people who share the same residence at least 3 months of the year) are not eligible to participate in the Sweepstakes or win any Sweepstakes Credit.

5. Sponsor and Promoter Disclosures. The Sponsor and Promoter of the Sweepstakes is Lothian Road WRX, Inc., with an address of 10869 N. Scottsdale Rd. Suite 504, Scottsdale, AZ 85254.

2. Obtaining Sweepstakes Credit.

1. How to Participate. Register for a free Andrew.Golf account and submit an entry according to this Sweeps Policy to receive your Sweepstakes Credits. Each Sweepstakes Credit grants you a $5 credit to your Andrew Golf account, which can only be used for entries and wagers on Andrew.Golf, has no cash or redemption value, and expires 60 days after issuance if unused.

2. Request by Mail.

                                               i.     To obtain Sweepstakes Credits via mail, Users must: (1) send a standard #10 envelope containing one 3” x 5” handwritten request card to the following address:

1.     On the envelope (A) handwrite your return address; and (B) include the words “Andrew Golf Sweepstakes Credit.”

2.     On one side of the request card, handwrite the following information: (A) full name (as shown on government-issued ID); (B) User’s email address registered to the User’s Andrew.Golf account; (C) User’s username associated with User’s Andrew.Golf account; (D) User’s User ID# associated with User’s Andrew.Golf account; (E) User’s return/residential address as provided in the User’s Andrew.Golf account; and (F) the statement: “I wish to receive free Sweepstakes Credits to participate in the promotions offered by Andrew.Golf. By submitting this request, I declare that I have read, understood, and agree to be bound by Andrew.Golf’s Terms of Service and Sweeps Policy.” 

3. Additional Terms. (A) Andrew.Golf reserves the right to verify eligibility and compliance of Users; (B) automated or systematic methods of Sweepstakes entry are prohibited; (C) Andrew.Golf’s decisions regarding all aspects of the Sweepstakes are final and binding; (D) Users agree to release Andrew.Golf and its affiliates from liability related to the Sweepstakes; (E) potential winners of Sweepstakes contests are subject to verification of eligibility and compliance; and (F) Andrew.Golf reserves the right to cancel, suspend, or modify the Sweepstakes or Sweeps Policy at any time. Written entries must be postmarked by the last day of the Sweepstakes period and received by us within seven calendar days thereof. Mail-in entries will be processed within 2-4 weeks of receipt. Please allow up to 6 weeks from the postmark date for your account to receive Sweepstakes Credit.

3. Sweepstakes Credit Can Be Used Only to Pay Entry Fees or Participate in Wagering.

1. Our decisions as to the administration and operation of the Sweepstakes are final and binding.

2. We reserve the right to change the credit value and odds of any of the Sweepstakes at any time. A User can see the actual and any amended details by consulting the specific rules of the Sweepstakes. It is a User’s responsibility to check the credit value of any Sweepstakes Credit on each occasion before they participate in any contest or otherwise interact with the Services.

3. Sweepstakes Credit Eligibility.

                                               i.     To be eligible for Sweepstakes Credit, a User must comply with this Sweeps Policy and the Terms.

                                             ii.     We are not liable for any taxes or fees associated with Sweepstakes Credit redemption. Users are responsible for all applicable taxes and fees related to receiving and/or redeeming Sweepstakes Credit. We may issue necessary tax forms and documents, such as a 1099, and file them with the appropriate tax authorities.

                                           iii.     Sweepstakes Credit cannot be transferred, and no substitutions will be made except at our sole discretion. We reserve the right to substitute Sweepstakes Credit with other credit for Services of equal or greater value for any reason due to circumstances beyond our reasonable control.

4. Participation Terms and Release. By engaging in our Sweepstakes, you agree, represent, and warrant that:

1. You have read, accept and agree to abide by this Sweeps Policy and the Terms (including policies integrated therein);

2. You understand and you must accept and agree to our decisions and discretion, which are binding and final;

3. To the maximum extent permitted by law, you release us and hold us harmless as well as any parent, subsidiary, affiliated companies, suppliers, and other organizations involved in sponsoring, fulfilling, administering, advertising, or promoting the Sweepstakes, as well as all their respective past and present officers, directors, employees, agents, attorneys, and representatives (collectively, the “Released Parties”) from any and all claims, expenses, and liabilities, including, but not limited to, negligence and damages of any kind to persons and property, invasion of privacy, defamation, slander, libel, violation of publicity rights, trademark infringement, copyright infringement, property damage, or death or personal injury arising from or related to a player's entry, creation or submission of an entry, participation in the Sweepstakes, Sweepstakes Credit acceptance or use or misuse, and/or the broadcast, exploitation or use of an entry; and

4. You will indemnify, defend, and hold us harmless from any and all claims, expenses, and liabilities (including reasonable attorney/legal fees).

5. Publicity. Unless forbidden by law, taking part in the Sweepstakes or requesting Sweepstakes Credit signifies each User’s agreement to allow us and our agents to utilize the User’s name, image, photograph, voice, opinions, and/or hometown and state/province/territory for promotional purposes in any media, globally, without additional compensation, notice, or consideration.

6. DISPUTE RESOLUTION. All disputes related in any way to the Sweeps Policy are governed by the dispute resolution provisions set forth in Section 10 of the Terms. Without limitation, such disputes are subject to the class/collective action wavier and mandatory arbitration provisions set forth therein.

7. CLASS ACTION WAIVER: Without limiting any provision of the Terms, by using our Services, you agree to waive and release your rights to participate in a class action or other class-based proceeding (including class-based arbitration).

8. LIMITATION OF LIABILITY. Our liability to you under the Sweeps Policy is limited as set forth in the Terms, of which this Sweeps Policy is an express part, as if fully restated therein.

9. Miscellaneous Terms.

1. Our Discretion. We reserve the right to cancel, suspend and/or modify the Sweepstakes or this Sweeps Policy, or any part of the Sweepstakes or this Sweeps Policy, with immediate effect owing to circumstances outside our reasonable control and only where circumstances make it unavoidable if any fraud, technical failures, or any other factor beyond our reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by us in our sole discretion.

2. Disqualification. We reserve the right in our sole discretion to disqualify any individual we reasonably determine to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of this Sweeps Policy or any other promotion or in an unsportsmanlike or disruptive manner.

3. No Illegal Conduct. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law and, should such an attempt be made, we reserve the right to seek damages from any such person to the fullest extent permitted by law. Our failure to enforce any term of this Sweeps Policy shall not constitute a waiver of that provision.

4. Entire Agreement. This Sweeps Policy is the entire agreement between you and us. There are no other agreements, any prior agreements, arrangements, or understandings have been merged into this Policy, except as otherwise stated herein with respect to incorporating the Terms.

5. Severability. To the extent that any part of the Sweeps Policy (or any of the integrated Terms) is found to be unenforceable or invalid by a court, the unenforceable or invalid portion shall be severed from the rest of the Sweeps Policy, and the remaining portions shall be given their full effect to the maximum extent permitted by law.

6. Notices to You by Email. You agree that we may provide any and all notices to you via email at the email address you provide at the time of Account registration, and that all such notices shall be deemed given at the time that they are sent.

7. Assignment. We may assign these terms at our discretion, in whole or in part, at any time without any notice to you. You may not assign the Sweeps Policy, or any license given to you by us in relation to the Sweeps Policy.

8. No Waiver. Any failure or delay by us to enforce any provision of this Sweeps Policy shall not constitute a waiver of any applicable rights or be construed to prevent us from enforcing such provisions in the future.
